June Regular Meeting Minutes

REGULAR BOARD MEETING
June 12, 2012

Douglas Mann, supervisor, offered a prayer for guidance at 7pm
He then called the meeting to order with Clerk, Vicki Gates, leading the Pledge of Allegiance

Correspondence
MTA dues will be paid in June as per our budget: $1,162.69
DNR recommends “Firewise” landscaping techniques to protect rural homes from wildfire:  30-foot open-space buffer between the home and tree line; remove small trees, household debris, brush and ground fuels (such as leaves and pine needles); store firewood away from the house and clear vegetation at least 10 feet away from LP tanks; plant short green grass; prune lower tree limbs to a height of 6-10 feet
Copy of L-4029 from equalization showing tax rates and taxable value
Public Act 135, signed by Gov. Rick Snyder, allows residents to file an affidavit to claim poverty exemption, rather than requiring federal & state income tax returns
House & Senate completed action on the state general fund budget and constitutional revenue sharing continues to see growth, PILT (payment-in-lieu-of-taxes) should be seeing an increase, and state income tax rate will be reduced from 4.35 to 4.25 on Oct 1st
House bill 4207 banns the uncontrolled burning of plastic, rubber, foam, chemically treated wood, textiles, electronics, chemicals, and hazardous materials. Rural residents still can burn yard waste such as brush & leaves, and household waste such as cardboard and paper products
Clean Sweep & Household Hazardous Waste Disposal in Lake, Mecosta & Osceola Counties:  October 13, 2012; S. Young-motion to approve “Agreement for Services” for $500 (same as last year), J. Fairbanks seconded; all in favor

Dignitary Reports
911-David Sanders, deputy director of 911-spoke of the 911 millage up for renewal on the August 7th primary ballot
Fire Dept- Marilyn Zdebski (attached)-out of 15 calls for the month, 10 of them were for Elk; fireman’s ball will be held at Skinner Park Aug. 4th
Commissioner-J. Fairbanks-MSU building sale for the historical society museum in Baldwin is proceeding; housing committee is looking for people to help with emergency repairs on their homes as well as ongoing rehabilitation of homes for low income residents
Cemetery- S.Young- the next cemetery board meeting will be August 6, 2012 @ Sauble @ 3pm
Assessor-absent, but Supervisor, D. Mann, would like it known that Bob Englebrecht completed his Masters degree for assessing

Supervisor-D. Mann-thanks to Lou Fitz, Roger Buckingham, Sharon & Jack Puff, and John Wagner for creating a picnic area at the twp hall; thanks to Dave Kott & Jim Abbott for the continued maintenance of the yellow bag receptacles; Summer clean up will be July 21st from 8am-1pm @ Skinner Park (anyone wishing to volunteer to assist in unloading please contact Vicki Gates, 266-8248); read excerpt from Statute 41.101 of Michigan Compiled Law which states, “A person who refuses to withdraw from a public meeting, on being ordered by the moderator to do so, is guilty of a misdemeanor punishable by a fine not exceeding $50.00.”

Trustees-J. Fairbanks-informed us that the Historical Society will be having a guest speaker, Robert Griffin (an old-time surveyor for this area), June 19th @ 7pm @ twp hall
S. Young-reported per the Road Commission that brining cost 2 ½ cents for the brine, which is all we are charged, and they spot brine early in the spring (in front of houses), then complete a full brine twice in the summer

Action Items
Ad Hoc Citizens Advisory Committee for road projects created with S. Young heading it up
Approval of contracts-S. Young-motion to accept contracts for janitorial, lawn maintenance @ twp hall grounds, snowplowing services, and maintaining twp marquee, J. Fairbanks seconded, all in favor
Purchase 30 triple braced, double-hinged, padded chairs for twp hall-V. Gates made motion to purchase from Jackpine, not to exceed $1200, J. Fairbanks seconded; all in favor
Installation of new front entrance with keyless entry locks-C. Draper made motion to accept Homer Grant’s bid for a 36” out-swing door with two 12” glass panels on either side, for a total of $1905, S. Young seconded; all in favor
Porta-Pottie for picnic area @ twp hall for $70/month/3 months including cleaning & insurance- V. Gates made motion to contract out, J. Fairbanks seconded; all in favor

Old Business
Six Mile Sink Hole update-supervisor-per Henry Diemer of Wilcox Engineering, grants are slim and the next step would be topographical survey & core samples for $5100; C. Draper made motion to table the Six Mile project indefinitely, V. Gates seconded; all in favor
Summer Clean Up Trash Day flyer will go out in tax statements the end of June
Stump removal for more parking is still being completed by J. Fairbanks, Lou Fitz, and Jeff Riggs; we will look into lighting that area after completion of work

New Business
D. Mann would like to investigate a new marquee, C. Draper made motion to approve the investigative work, S. Young seconded; all in favor
Public Comment-Johnny Gates mentioned that J. Fairbanks could investigate an historical sign for the twp hall & collaborate with D. Mann

Road Millage Renewal

ROAD IMPROVEMENTS & MAINTENANCE MILLAGE PROPOSAL
August 2012




Shall ­­­­­­­­ELK Township impose an increase of up to .5 mills ($.50 per $1,000 of taxable value) in the tax limitation imposed under Article IX, Sec. 6 of the Michigan Constitution and levy it for five (5) year(s), 2013 to 2017, inclusive, for road improvements and maintenance, which .5-mill increase will raise an estimated $33,214 in 2013, the first year the millage is levied.

Dignitary Reports
·         Fire Dept- Marilyn Zdebski (attached)-special thanks to whoever dropped off the Gatorade for the firefighters 
·         Commissioner-J. Fairbanks-please vote for the 911 millage renewal;  the county is looking into turning over lands where the present MSU Extension & Chamber of Commerce building is located to the historical society for the purpose of constructing a museum in Baldwin
·         Cemetery- S.Young, liaison-the next cemetery board meeting will be August 6, 2012 @ Sauble @ 3pm;  a big “thanks” goes out to J. Fairbanks for planting 136 pine tree (donated) in the cemetery to define the grave sites as people have been driving over 20 graves; the cemetery board would like to have a Martin Johnson memorial to be paid for with donations; the old tractor was sold as scrap, then bought back by J. Fairbanks to give to Pete Shakinas (prior sexton/maintenance worker); a recommendation has come from the cemetery board to combine the sexton & lawn maintenance positions into a one-person position, as it used to be in the near past; S. Young made a motion to confirm the cemetery board’s recommendation to combine the sexton/maintenance positions into one position, V. Gates seconded, all in favor

Supervisor-D. Mann-thanks to Lou Fitz & J. Fairbanks for cleaning up the township grounds; fire permits may be obtained online @ www.michigandnr.com/burnpermits, or by calling 1.866.922.2876

Trustees-J. Fairbanks-the engineering report from Wilcox indicates 28 feet of muck in the six-mile road investigation, and would cost $400,000 to fix correctly; it was decided to request Wilcox to attend another township meeting to narrow down our options; suggestion that the Board of Review members attend a refresher class

S. Young-attended a Township Association Meeting @ Sauble on April 26, 2012, and reports that 211 is up and running 24/7, this is a number to be called concerning available community service information and volunteer opportunities; August 23, 2012 will be the next Township Association meeting, 7:30pm @ Lake Twp

Action Items
·         Resolution and language approved for a road millage renewal of .5 mill (one-half mill) to be placed on the August 7, 2012 ballot-J. Fairbanks made motion, C. Draper seconded, all in favor by roll call vote; a big “thanks” goes out to Johnel Buckingham for help in the language wording
·         Supervisor looking into Trash Day date @ Skinner Park (maybe July 21st, tba)
·         J. Fairbanks-motion to draft a letter to DNR requesting Bluegill Lake designation as a “no motor lake”, S. Young seconded, all in favor
·         J. Fairbanks-motion to create contracts & job descriptions for janitorial, pest control, lawn maintenance @ twp hall grounds, and snowplowing services, S. Young seconded, all in favor
Old Business
·         Park Project-J. Fairbanks made motion to allow volunteers (under direction of Lou Fitz) to build wooden picnic tables, order & install a grill, and trim trees north of the twp hall for the purpose of providing a recreational park to be used by the community on twp grounds, S. Young seconded, all in favor (this will be donated materials as well as labor)

New Business
·         D. Mann is seeking volunteers for an ad hoc citizens advisory committee to look at road projects

Public Comment-Lou Fitz believes it is time to do something to renovate the township building; J. Fairbanks would like to have an open town hall style meeting to discuss options for renovating the building; Harry Mead believes we should make up our minds of what we want to accomplish in regards to our township building; Rob Brenner has complaints regarding the Board of Review and how he was treated; Matt Forsyth requests if people have a problem concerning his property on the corner of Brooks Rd & 12 Mile Rd, they should call him personally

Salary Resolutions-all to remain the same as last year
                Supervisor-$8,500, motion offered by John Gorys, seconded by Phil VanVleet, passed
                Treasurer-$11,500, motion offered by Phil VanVleet, seconded by Charlie Young, passed
                Clerk-$9,500, motion offered by Charlie Young, seconded by John Gorys, passed
                Trustees remain as a Per Diem/Per Day wage @ $95 as reflected in the budget

Proposed budget for 2012-2013 fiscal year, beginning April 1, 2012 (see attached)

·         Commissioner-John Fairbanks-various issues at the county level

Supervisor-D. Mann-State of the Township report & a big thanks to the Board of Review for all their efforts

Trustees-S. Young-believes the township board has worked well together & that the budget looks good

Public Comment-Rob Brenner spoke because he believes he was wronged by the Board of Review

Yellow Bag Drop Boxes, Dropped off...

A huge Thanks goes out to Jim Abbott & those who helped him drop off the Yellow Bag Drop Boxes. These may be used by anyone wishing to contain their yellow bags so the animals don't rip them up by the time Allied Waste comes to dispose of them:



The first one is Granger Rd south of 10 1/2 Mile Rd and is being used regularly.
The second one is in the K & K parking lot at 10 1/2 Mile Rd and Bass Lake Rds.
The third is on the SE corner of Bass lake and 8 Mile Rds.
The fourth is a about 100 yards south of 9 mile on Johnson Rd near the the sand pit sign.


 
Allied Waste has been notified of the locations and has issued an order for the drivers to pick up at these four locations.
